Black Sand Box is a surf project based in São Miguel, Azores, Portugal, offering lessons for all ages, premium equipment rental, events and social action from our black sand beaches. In these terms, “we”, “us” and “our” refer to Black Sand Box, and “you” refers to the person using our site or services.

You may use this website for your own personal, non-commercial purposes and to learn about and book our services. You agree not to misuse the site, disrupt its normal operation, attempt to gain unauthorised access to it, or use it for any unlawful purpose.

All content on this site, including text, photographs, video, graphics, logos and page design, is owned by or licensed to Black Sand Box and is protected by copyright and other intellectual-property laws. You may view and share this content for personal, non-commercial use, but you may not copy, reproduce, republish or use it commercially without our prior written permission.

The Black Sand Box name, logo and related marks are trademarks of Black Sand Box. The names, logos and marks of our partners and of third-party brands shown on the site (such as equipment manufacturers) remain the property of their respective owners. Nothing on this site grants you any right to use these marks.

When you book a lesson or activity, you agree to provide accurate booking details and to pay the price shown at the time of booking. Prices are displayed in euros and, where applicable, include VAT. Card payments are processed securely by our payment provider, Stripe; we do not store your full card details. A booking is confirmed only once payment and confirmation are complete. Lessons are subject to instructor availability, group sizes, minimum age or ability requirements, and suitable ocean and weather conditions.

Equipment we rent to you remains the property of Black Sand Box. You agree to use it with reasonable care, only for its intended purpose, and to return it on time and in the condition you received it, allowing for normal wear. You are responsible for loss of, or damage to, rented equipment beyond normal wear while it is in your care, and reasonable charges may apply.

Surfing depends on weather, sea state and safety. We may reschedule or cancel an activity for safety reasons or for conditions beyond our control; in that case we will offer you an alternative time or a full refund for the affected activity. If you need to cancel or change your booking, please contact us as early as possible. Refunds are only available for cancellations made at least 48 hours before the scheduled start of the lesson or activity: within that 48-hour window the booking is non-refundable, although we will always try to offer you an alternative time where we can.

Surfing, skating and related activities are physical outdoor sports that carry inherent risks, including the risk of injury. By taking part, you confirm that you are in adequate health to do so, that you have disclosed any relevant medical conditions, and that you will follow the instructions and safety guidance given by our instructors at all times. Participants who are minors must have the consent of a parent or guardian. You take part voluntarily and accept the ordinary risks inherent in these activities.

We respect your privacy and use analytics cookies only to understand how the site is used. How we handle your personal data is explained in our Privacy Policy, which forms part of these terms.

Our site relies on and links to third-party services: for example, WhatsApp for contact, Stripe for payments and Google Analytics for anonymous usage statistics. It may also link to partner or other third-party websites. We do not control these services or sites and are not responsible for their content, practices or availability. Your use of them is governed by their own terms and privacy policies.

We aim to keep the site and our services available and accurate, but we provide them on an “as is” and “as available” basis. We do not guarantee that the site will always be uninterrupted or error-free, that information such as schedules or prices is free of occasional mistakes, or that any particular activity will run. We may update, suspend or withdraw parts of the site or our services at any time.

To the extent permitted by law, Black Sand Box is not liable for indirect or consequential loss, or for loss or damage arising from your use of the site, from third-party services, or from risks inherent in surfing, skating and related activities that you have voluntarily accepted. Nothing in these terms limits any liability that cannot be limited under applicable Portuguese law, including liability for death or personal injury caused by our negligence.

You agree to be responsible for, and to reimburse us for, any reasonable loss or claim that arises from your breach of these terms or your misuse of the site, our services or rented equipment.

These terms are governed by the laws of Portugal, and any dispute relating to them or to our services is subject to the competent Portuguese courts, without prejudice to any mandatory consumer-protection rights you may have under the law of your country of residence.

We may update these Terms & Conditions from time to time to reflect changes to our services or for legal reasons. The current version is always the one published on this page, with the “last updated” date shown above. By continuing to use the site or book our services after an update, you accept the revised terms.
